Welcome to MovePlay (“the App”), provided by Bitwise Software, SL. By downloading, installing, or using MovePlay, you agree to be bound by these Terms of Service (“Terms”). If you do not agree, please do not use the App.
1. Use of the app
MovePlay is designed for users ages 8 and older and is primarily intended for children’s active play. Parents or guardians are responsible for reviewing and consenting to their child’s use of the App. By allowing a child to use MovePlay, you represent and warrant that you are the child’s parent or legal guardian and consent to their use.
2. Privacy and data
MovePlay does not collect, store, or transmit any photos, videos, or audio recordings. The App uses the device’s camera solely for real-time motion and gesture detection. This detection happens entirely on the device and no image, video, or recording is saved or sent to any server. We may collect basic, non-personal usage data (such as crash reports or anonymized analytics) to improve the App.
3. Health and Safety
MovePlay is an active game that encourages physical movement. Please ensure you play in a safe environment, free of obstacles, and that children are supervised when necessary.
By using the App, you acknowledge and agree that Bitwise Software, SL is not liable for any injuries, accidents, or damages that may occur while using MovePlay.
4. Age Requirements
MovePlay is intended for children ages 8 and older, under the supervision and consent of a parent or guardian. Parents/guardians are fully responsible for the child’s use of the App and for ensuring it is appropriate for their child.
5. Intellectual Property
All content in the App, including graphics, text, animations, and code, are the property of Bitwise Software, SL. and are protected by copyright and other laws. You may not copy, modify, distribute, or reverse engineer any part of the App without prior written permission.
6. Disclaimer of Warranties
MovePlay is provided “as is” and “as available” without warranties of any kind. We do not guarantee that the App will be error-free, uninterrupted, or meet your specific requirements.
7. Limitation of Liability
To the maximum extent permitted by law, Bitwise Software, SL. shall not be liable for any indirect, incidental, or consequential damages, including but not limited to personal injury, property damage, or data loss resulting from the use of MovePlay.
8. Subscriptions and Purchases
Certain features of MovePlay may require a paid subscription. Subscriptions and all in-app purchases are processed exclusively through the Apple App Store under your Apple ID. By completing a purchase, you agree that all payments are final and no refunds will be provided after the purchase is made, except as required by Apple’s refund policies. You are responsible for managing your subscription, including cancellations or changes, directly through your Apple ID account settings.
9. Changes to the Terms
We may update these Terms from time to time. Continued use of the App after changes are made constitutes acceptance of the updated Terms.
